for the hotel accommodation contract
1. These terms and conditions apply to contracts concerning the rental provision of hotel rooms for accommodation, as well as all other services and deliveries provided by the hotel to the customer.
2. Subletting or re-renting the rooms provided, as well as their use for purposes other than accommodation, require the prior written consent of the hotel, whereby § 540 paragraph 1 sentence 2 BGB is excluded insofar as the customer is not a consumer.
3. The customer's terms and conditions shall apply only if this has been expressly agreed in writing.
1. The contract is concluded by the hotel's acceptance of the customer's offer. The hotel is free to confirm the room booking in writing.
2. The contracting parties are the hotel and the customer. If a third party has booked for the customer, they shall be jointly and severally liable with the customer to the hotel for all obligations arising from the hotel accommodation contract.
3. All claims against the hotel generally become time-barred after one year from the commencement of the knowledge-dependent regular limitation period under § 199 (1) BGB. Claims for damages become time-barred after five years regardless of knowledge.
1. The hotel is obliged to make the rooms booked by the customer available and to provide the agreed services.
2. The customer is obliged to pay the hotel's applicable or agreed prices for the provision of the rooms and for any additional services used by them.
3. The agreed prices include the respective statutory value-added tax. If the period between conclusion of the contract and performance of the contract exceeds the months and the price generally charged by the hotel for such services increases, the hotel may increase the contractually agreed price reasonably, but by no more than 5 %.
5. Invoices from the hotel without a due date are payable within 10 days of receipt of the invoice without deduction.
1. A cancellation by the customer of the contract concluded with the hotel requires the hotel's written consent. If such consent is not given, the agreed price under the contract is still payable even if the customer does not make use of contractual services.
4. The hotel is free to demand the contractually agreed remuneration and to lump-sum the deduction for saved expenses. In this case, the customer is obliged to pay at least 90 % of the contractually agreed price for overnight stays with or without breakfast, 70 % for half-board and 60 % for full-board arrangements.
If the customer has been granted a free right of cancellation, the hotel is likewise entitled to withdraw from the contract during this period if there are enquiries from other customers and the customer, upon the hotel's request, does not waive their right to cancel.
Furthermore, the hotel is entitled to withdraw from the contract extraordinarily for objectively justified reasons — for example in the case of force majeure, misleading information or a justified reason to assume a threat to business operations.
1. The customer is not entitled to the provision of specific rooms.
2. Booked rooms are available to the customer from 15:00 on the agreed day of arrival.
3. On the agreed day of departure, the rooms must be vacated and made available to the hotel no later than 12:00. Thereafter the hotel may charge 50 % of the full accommodation price for use beyond the contracted time until 18:00, and 100 % from 18:00 onwards.
1. The hotel is liable for its obligations under the contract with the care of a prudent businessman.
2. For items brought in, the hotel is liable to the customer in accordance with statutory provisions, that is up to one hundred times the room price, at most 3.500,00 Euro, and for money and valuables up to 800,00 Euro.
3. If a parking space in the hotel garage or in a hotel car park is made available to the customer, this does not constitute a contract of safekeeping.
1. Amendments or additions to the contract should be made in writing.
2. Place of performance and payment is the registered office of the hotel.
4. In commercial transactions, the exclusive place of jurisdiction is the registered office of the hotel.
5. German law shall apply. The application of the UN Convention on Contracts for the International Sale of Goods and of conflict-of-law rules is excluded.
6. Should individual provisions be invalid or void, this shall not affect the validity of the remaining provisions.
